A First: Indonesian Court Grants Enforcement of an Indonesia Arbitration Center (APIAC) Award

On October 3, 2024, the Indonesia Branch of the Asia Pacific International Arbitration Chamber successfully registered its first arbitral award with the South Jakarta District Court. This was the first time an Indonesian court recognized the legal effect of an arbitral award issued by the Asia Pacific International Arbitration Chamber (Indonesia).

Article 59 of Law No. 30 of 1999 of the Republic of Indonesia on Arbitration and Alternative Dispute Resolution requires an official copy of an arbitral award to be submitted to a district court for registration within thirty days of its issuance.

In this case, the arbitration clause provided: “Disputes shall be submitted to the Indonesia Branch of the Asia Pacific International Arbitration Chamber. The number of Arbitrators shall be 1, and the place of arbitration shall be Jakarta, Indonesia. The arbitral award shall be final and binding on both parties.” After the claimant submitted a request for arbitration to the Indonesia Arbitration and Mediation Center (APIAC), the case was heard by a sole Arbitrator, who issued the arbitral award on September 30, 2024. The Secretariat of the Indonesia Arbitration and Mediation Center (APIAC) registered the award with the South Jakarta District Court on October 3, 2024.
